DHS Secretary Reduces Haiti Temporary Protected Status (TPS) Designation and Redesignation to 12 Months; EADs Expire Aug. 3, 2025
On Feb. 20, 2025, Secretary of Homeland Security Kristi Noem partially vacated the July 1, 2024, notice that extended and redesignated Haiti for Temporary Protected Status (TPS). This new notice amends the period of extension and redesignation of Haiti for TPS from 18 months to 12 months and provides an amended end date of Aug. 3, 2025. EADs with a Category Code of A12 or C19 and a Card Expires expiration date of Feb. 3, 2026, now expire on Aug. 3, 2025.
Completing Form I-9
To complete Form I-9, Employment Eligibility Verification, for TPS Haiti beneficiaries who present an EAD with a Category Code of A12 or C19 and a Card Expires date of Feb. 3, 2026; Aug. 3, 2024; June 30, 2024; or Feb. 3, 2023; Dec. 31, 2022; Oct. 4, 2021; Jan. 4, 2021; Jan. 2, 2020; July 22, 2019; Jan. 22, 2018; or July 22, 2017, enter Aug. 3, 2025, on Form I-9 as the expiration date of these EADs.
USCIS will not provide updated EADs with the amended Aug. 3, 2025, expiration date. You must correct previously completed Forms I-9 for each employee that previously presented an EAD with a Feb. 3, 2026, expiration date to include the amended expiration date of Aug. 3, 2025. In Section 2 of the employee’s Form I-9, enter the amended Aug. 3, 2025, expiration date in the Additional Information field, and initial and date the correction. You must reverify these employees before they start work on Aug. 4, 2025.
