Stateless Noncitizens Present in the United States
U.S. Citizenship and Immigration Services (USCIS) invites you to participate in an engagement on Stateless Noncitizens Present in the United States on Tuesday Dec. 5, from 2 to 3 p.m. Eastern.
On Dec. 15, 2021, the U.S. Department of Homeland Security (DHS) announced its commitment to enhance protections for stateless noncitizens living in the United States. DHS recognizes that a significant number of stateless noncitizens are present in the United States and face serious challenges and obstacles because they have no officially recognized nationality. They often lack access to basic documentation, such as birth certificates, as well as documentation or evidence of their statelessness.
On Aug. 1, 2023, USCIS issued guidance in the USCIS Policy Manual to address stateless noncitizens present in the United States and clarify the circumstances under which USCIS may generally consider a noncitizen stateless for immigration purposes. USCIS also announced a new specialized internal process for examining statelessness and producing an internal report, following an adjudicating officer’s request. This guidance went into effect on Oct. 30, 2023.
During this engagement, USCIS will provide an overview of its policy on stateless noncitizens and the implementation process. We will then hold a question-and-answer session. We will not address case-specific questions, questions outside the scope of the engagement, or issues under active litigation.
