Ukrainian Employees with Parole
The Ukraine Security Supplemental Appropriations Act, 2024, was recently signed into law. Due to the passage of this law, guidance that “UHP” and “DT” parolees must have entered by Sept. 30, 2023, has been changed to Sept 30, 2024. In light of this legislation, we updated our guidance below regarding which Ukrainian parolees are employment authorized incident to their parole and may present their unexpired Form I-94 as an acceptable List A receipt that temporarily shows identity and employment authorization for Form I-9, Employment Eligibility Verification for up to 90 days from the date of hire or in the case of reverification, when the date employment authorization expires:
- Employees whose unexpired Form I-94 shows a class of admission of “UHP” and a most recent date of entry on or before Sept. 30, 2024; or
- Employees whose unexpired Form I-94 contains a class of admission of “DT” issued between Feb. 24, 2022, and Sept. 30, 2024 and indicates Ukraine as the country of citizenship on the document.
Employees who are paroled after Sept. 30, 2024, must provide an unexpired EAD (or other acceptable documents from the Lists of Acceptable Documents).
